Welcome to Smartlink Services pkb ("we", "our", "us"). By using our website, purchasing our internet services, or accessing our network, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Smartlink Services. By using our services, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Our Services

We provide wireless broadband internet services, including but not limited to:

  • Unlimited and limited data plans (daily, weekly, monthly).
  • Network installation and support.
  • Managed network services for businesses.
  • IP surveillance and firewall solutions (by separate agreement).

Service availability and speeds depend on your location and network conditions. We strive to maintain 99.9% uptime but do not guarantee uninterrupted service.

3. User Accounts and Registration

To access certain services, you must register for an account. You agree to:

  • Provide accurate and complete information during registration.
  • Keep your login credentials confidential.
  • Notify us immediately of any unauthorised use of your account.
  • Be responsible for all activities conducted under your account.

4. Payments and Billing

All charges are in Ghana Cedis (GHS) and are inclusive of applicable taxes. Payment is processed securely via Paystack using mobile money or bank transfer. By purchasing a voucher or subscribing to a plan, you authorise us to charge the specified amount.

  • Voucher purchases are non‑refundable once the voucher code has been generated and delivered.
  • Recurring subscriptions will be billed at the beginning of each billing cycle. You are responsible for ensuring your payment method is valid and has sufficient funds.
  • We reserve the right to suspend or terminate services for non‑payment.

5. Acceptable Use Policy

You agree not to use our services for any unlawful, harmful, or abusive purpose, including but not limited to:

  • Engaging in illegal activities (e.g., fraud, hacking, distribution of malware).
  • Transmitting obscene, defamatory, or infringing content.
  • Interfering with network performance or other users' experience.
  • Reselling or sharing your internet connection without our prior written consent.

Violation of this policy may result in immediate termination of your service without refund.

6. Cancellation and Termination

You may cancel your subscription at any time through your account dashboard. Cancellations will take effect at the end of the current billing cycle. No refunds will be given for partial months.

We may suspend or terminate your account if we believe you have violated these Terms or if your conduct poses a risk to our network or other users.

7. Intellectual Property

All content on our website, including text, graphics, logos, and software, is the property of Smartlink Services or its licensors and is protected by copyright and trademark laws. You may not reproduce, modify, or distribute any content without our express permission.

8. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the reliability, speed, or availability of the service. We do not guarantee that the service will meet your specific requirements or be uninterrupted, secure, or error‑free.

9. Limitation of Liability

To the fullest extent permitted by law, Smartlink Services shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services. Our total liability to you shall not exceed the amount you paid us in the three (3) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Smartlink Services and its employees, officers, and agents from any claims, losses, damages, or expenses (including legal fees) arising from your breach of these Terms or your misuse of our services.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Ghana. Any disputes arising under these Terms shall be resolved exclusively in the courts of Ghana, located in Kumasi.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting a prominent notice on our website or by email. Your continued use of our services after the effective date of changes constitutes acceptance of the revised Terms.
